Terms of Service

These terms govern your use of the MotionReach website (motionreach.co.uk)
and the MotionReach dashboard and related services (together, "the Service").
The Service is operated by Elevate Fitness Studios Ltd, a company registered in England and Wales under company number 14881338, with its registered office at c/o Price & Accountants Ltd, WeWork, 1 Fore Street Avenue, London EC2Y 9DT. VAT number GB491188760. Elevate Fitness Studios Ltd trades under the names "MotionReach" and "MotionReach Digital" (collectively "MotionReach", "we", "us", "our") for the purposes of the Service described in these terms.
By using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. The Service
MotionReach builds and operates websites, and provides a dashboard that reports on performance, SEO, uptime, and related metrics for those websites. The exact scope of work for a given client is set out in the agreement signed with that client.
2. Eligibility
- You must be at least 18 years old to use the Service.
- If you are using the Service on behalf of a business, you confirm you have authority to bind that business to these terms.
- The Service is intended for use by businesses in the United Kingdom. We may decline to provide the Service outside that territory.
3. Accounts
You are responsible for keeping your dashboard login credentials secure. We authenticate via Clerk; you must not share your login, and you must tell us immediately if you believe your account has been compromised.
4. Fees and payment
During the pilot phase, the Service may be offered to a limited number of clients at no cost or at a discounted rate. For clients outside the pilot, fees are disclosed in the client agreement signed at onboarding. Fees are charged in pounds sterling (GBP).
Where fees apply, they are billed monthly in advance unless otherwise agreed. Late payment may result in the Service being suspended.
5. Acceptable use
You agree not to:
- Use the Service to break any law or regulation.
- Attempt to gain unauthorised access to any part of the Service, other users' accounts, or the underlying infrastructure.
- Publish on a MotionReach-built site any content that is defamatory, infringes third- party rights, or breaches the Advertising Standards Authority's rules on fitness and health claims.
- Use the Service to send unsolicited marketing communications, including to Google Business Profile reviewers.
6. Our responsibilities
- We will use reasonable care and skill to keep the Service available, accurate, and secure. We do not promise uninterrupted access.
- We aim for 99.9% monthly uptime on hosted client sites and on the dashboard, measured across a calendar month and excluding scheduled maintenance.
- We rely on third-party platforms (including Render, Neon, Clerk, Google, and UptimeRobot). Outages or changes in those platforms may affect the Service, and we cannot always prevent that.
7. Intellectual property
- You retain ownership of any content you supply (text, images, logos, brand assets). You grant us a non-exclusive licence to use, reproduce, and display that content as needed to operate the Service.
- We retain ownership of the MotionReach dashboard, its source code, its integrations, and any tooling built around the Service. Nothing in these terms grants you rights to that underlying platform.
- Bespoke website designs and code created for you as part of a client engagement are licensed to you for the duration of your subscription. On termination, we will cooperate in good faith to hand over a static export of your site.
8. Termination
- You may cancel at any time by emailing hello@motionreach.co.uk. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate your access if you materially breach these terms, misuse the Service, or fail to pay fees when due. We will give reasonable notice where possible.
- On termination we will delete your account data and any connected OAuth tokens within 30 days, as described in our Privacy Policy.
9. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under English law.
Subject to the above, our total liability to you in connection with the Service in any 12-month period is limited to the fees you have paid us in that period. We are not liable for indirect or consequential losses, loss of profits, loss of business, or loss of reputation.
10. Changes to the Service and to these terms
We may change the Service or these terms from time to time. Where a change materially affects your use of the Service, we will tell you by email at least 14 days in advance. Continuing to use the Service after a change takes effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of England and Wales. You and MotionReach submit to the exclusive jurisdiction of the courts of England and Wales.
